Over 40 states have legalized cannabis in some form, whether medically, recreationally, or through decriminalization. Meanwhile, at the federal level, marijuana is still classified as a Schedule I substance, putting it in the same category as heroin. That is outdated, unjust, and damaging. Texas made its first small step in 2015 with the Compassionate Use Act, allowing low THC cannabis oil for a limited group of patients. Over time, that program was slightly expanded to include PTSD and terminal cancer, but even now it limits THC to just 1 percent. Most states allow five to ten times that amount. Then came the 2018 Federal Farm Bill, which legalized hemp containing less than 0.3 percent Delta 9 THC by dry weight. That opened the door to hemp-derived cannabinoids like Delta 8 and Delta 9, and Texans started finding relief. These products helped people manage anxiety, pain, insomnia, PTSD, and more without the side effects or addiction risks of many prescription medications. But now in 2023 and 2024, Texas lawmakers are coming after those same products. Senate Bill 264 and House Bill 2818 were introduced under the claim of regulating hemp, but their real goal is to heavily restrict or outright ban Delta 8, Delta 9, and similar hemp-derived THC products. These bills would impose caps on THC content, strict lab requirements, and retail restrictions that most small businesses cannot afford to comply with. Let’s be clear. This is not about public health. It is about control. These bans hurt real people. Veterans. Cancer patients. Parents of children with special needs. Working adults with chronic conditions. They take away access to affordable natural relief and threaten an entire industry that has created jobs, reduced black market activity, and generated real tax revenue. We have already seen the results in states that fully legalized cannabis. They have experienced fewer opioid deaths, lower violent crime, thousands of new small businesses, and billions in tax revenue that fund education, health care, and community programs. Imagine if we taxed THC like we do alcohol or cigarettes. We could use that money to reduce our national debt, expand mental health care, and provide real support where it is needed most. But instead of progress, Texas keeps going backward. Here is what we need to do. First, we must push for federal legalization. Cannabis should be removed from the Schedule I list and treated like alcohol, with national standards for safety and regulation. Second, we need to stop the attacks happening in Texas. These bans do not protect people. They punish them. Bills like SB 264 and HB 2818 are not about health. They are about shutting down access, silencing relief, and protecting outdated interests.
